Terms and Conditions,

        1. Whirlybird Australia These terms and conditions (the “Terms and Conditions”) apply to all sales of the whirlybird, Eco solar vents, solar ventilation fans, Edmond’s Whirlybird and ventilation product or products (the “Product”) sold remotely through the website www.wawhirlybirds.com.au (the “Website”).
        2. The Terms and Conditions constitute the entire Agreement between (“us” / “we” / “our”) and those parties who purchase Product through the Website (the “Customer”).
        3. The Customer by placing an Order for Product through the Website is taken to have read, understood and accept these Terms and Conditions.
        4. The Terms and Conditions are subject to the laws of Australia and any dispute with respect to these Terms and Conditions are subject to the jurisdiction of the Courts of Western Australia.
        5. The Customer if a natural person warrants that they over eighteen (18) years of age and legally capable of entering into a legally binding contract.
      1. PURCHASE OF PRODUCT
        1. We reserve the right to cancel the Order after being placed by the Customer in the event that the materials used to manufacture the Product become unavailable or our manufacturing capabilities are compromised for whatever reason. In the event that we cancel an Order for this reason a full refund of the purchase price will be made to the Customer without deduction and we will notify the Customer of the cancellation by email transmission.
        2. Upon acceptance of the Order by us, we will send to the Customer a Tax Invoice and Receipt of the Products of purchase.                                                                                                                                                                                                       PRICING
        1. All prices on the Whirlybird Australia  Website are in Australian dollars ($AUSTRALIAN).
        2. Pricing is subject to change by us from time to time, but we will complete delivery of the Product to the Customer at the price that the customer is quoted before completing the Order on the Website.
        3. DELIVERY OF PRODUCT
        1. On completion of the order, whirlybirds or solar vents is subject of the Order and once the Product has been packaged ready for delivery, we will by email transmission forward to the Customer a Delivery Note outlining our courier details, date of departure for our manufacturer and a tracking number.
        2. The cost of Delivery is at the cost of the Customer (if not free delivery) and is paid on completion of the Order on the Website.
        3. We undertake only to use reputable courier companies who provide an online tracking system.
        4. It is the responsibility of the Customer to track delivery of the Product and to notify us in the event that the Product is not delivered within a reasonable time frame.
        5. It is the responsibility of the Customer to notify us in the event that the Product is delivered to the Customer and the number of packages outlined on the Delivery Notes is not received or the delivered packages are not intact, wet or damaged.
        6. On delivery of the Product to the Customer, the Contract between the Customer and us is concluded.
      2. PRODUCT INFORMATION
        1. Information with respect to Product sold by us is available on the Website wawhirlybirds.com.au.
        2. We undertake to provide constantly updated information on our Website, however the complete absence of errors cannot be guaranteed. The Website may contain errors, inaccuracies or omissions and we reserve the right to correct any errors, inaccuracies or omissions even after the Order has been completed. We also reserve the right to change or update our Website at any time without Notice to a Customer with a pending Order.
      3. MANUFACTURING DEFECTS
    2. If a Product on delivery shows a manufacturing defect we will provide to the Customer a full refund of the purchase price subject to our Returns Policy.AUTHENTICITY AND INTELLECTUAL PROPERTY
      1. We guarantee the authenticity of all our Products, Typhoon, Amplite, CSR Edmonds Whirlybirds and Eco solar vents which are made using only the finest available materials.
      2. Warranty 1        If a Product on delivery shows a manufacturing defect, we will provide to the Customer a full refund of the purchase price subject to our Returns Policy.
      3.          5 year warranty will repair or replace the product if its stops working under normal weather conditions.8.3         Product warranty does not include storm damage or flying objects smashing the product.
      4.          Product warranty does not include fan noise of the product under normal working conditions.
      5. Eco solar vents Product Warranty does not include fan noise. Eco solar vents are a powered unit and have a no Noise motor but they have a powered fan so they will operate with a noise or will operate with a noise of a fan inside your roof. With a ceiling above the sound will be whisper quiet while its operation is under full sunlight, but due to different people’s noise tolerance and different types of ceiling, ceiling with no insulation, this could sound louder or there could be no sound at all.
      6.          All product warranties are under warranty from the manufacturer. labour cost is an extra charge and will be forward to the customer.

Dints in the whirlybirds from Transport.

  1. Best to Call Glenn on fixing any problems on 0412412101 as we are here to help.
  2. Whirlybirds can be fixed and the dints can be pressed or pulled out. This takes time so we are happy to refund for the time spent to fix any dints.
  3. During delivery whirlybirds may get dint from transport. If this happens you can press them out to the best of your ability. For 600 mm whirlybirds we can refund for your time only to do this at $25 per whirlybird. should only take 5 to 10 minutes Please send photos
  4.  900 mm whirlybirds can also get dints in the top during transport. If this happens you can pop the top back out. To pop the top out its best to use a small rivet and pull the dint out. Use rivet gun to lock the rivet half in and then pull the rivet out. The dints will pop out. We can refund $50 to $100 per unit for the time to get them looking Good again. Should only take 10 to 20 minutes Please send photos
  5. whirlybird Australia has a No Returns policy for dints in the whirlybirds. Whirlybirds can be fixed and the dints can be pressed or pulled out. We are happy to pay for your time to do this as it does not happen much. Please send in pictures to claim Warranty

Returns Policy

  1.  If a Product on delivery shows a transport defect, Do not use the unit. Please take Photo’s and send then through to us.
  2.  If a Product on delivery shows a Transport defect, we will send new units upon return of the receiving the damaged whirlybirds
  3.  If a Product on delivery shows Damage. Do not except the units and ask for it to be returned by the transport company. Take photos
  4.  To Claim new whirlybirds you must return the products in the boxes to Melbourne or Perth.
  5. We are not responsible for third party damage caused from Transport.
  6. We are not responsible for Damage causes during installation or by bad workmanship.
  7.  Return Transport cost will not be refunded by whirlybird Australia.
  8.  All Products will be shipped in New condition so Photo and video evidence will be needed for warranty claims
  9.  Labour cost is not under Warranty. Do Not Install whirlybirds if you think they have been damaged.
  10.  Product warranty does not include Transport damage. to claim transport damage you must go direct to the service provider.
  11.  Product warranty does not include fan noise of the product under normal working conditions.

Roof Leaks Warranty.

  1. We will fix any roof leak for up to 5 years after installation but if extra over-flashing is required you will be charged.
  2. If the roof leak is caused by not installing a over-flashing we are not responsible for this. We will always tell you if an over-flashing is required and extra charges will apply for the cost and instillation for an over-flashing. This is due to different types and colours of roofs and the over-flashings will need to be made to order. With the correct over-flashing the roof is 100% water tight.
  3. We will Give 45 days Warranty (45 days after the installation date on the invoice) on any damage that is caused by any roof leak after the instillation. We give a 99.9% chance that if installed under the top ridge or under an over-flashing that you will never get a roof leak for 20 years.

Eco solar vents warranty.

  1. If a Product on delivery shows a manufacturing defect we will provide to the Customer a full refund of the purchase price subject to our Returns Policy.
  2. 5 year warranty will repair or replace the product if its stops working under normal weather conditions. Eco solar vents will pay for the products only or parts needed to fix the product. Labour cost will be paid for buy the client, not Eco solar vents.
  3. Product warranty does not include storm damage or flying objects smashing the product.
  4. Product warranty does not include fan noise of the product under normal working conditions.
  5. Eco solar vents Product Warranty does not cover motor noise from units install before 2020.  Eco solar vents are a powered unit and have a powered fan so they will operate with a noise or will operate with a noise of a fan inside your roof.
  6. With a ceiling above the sound will be whisper quiet while its operation is under full sunlight, but due to different people’s noise tolerance and ceiling insulation this could sound louder or there could be no sound at all. New 2020 motors have no sound now! so they are very hard to hear. We also have switches available to give people full control of the Eco solar vent.
  7. The Eco solar vents run from the power of the sun. this will change the fan speed and the sound of the fan, example full sunlight to cloudy patches. This is normal and the sound will change.
  8. Eco solar vents will not do free solar vent inspections to tell you if or if not your solar vent is working. but you can pay $150.00 for this service and we will service the unit and replace the motor.

Late Payments Fees,

9.1          Late payment fee and account keeping fee of $99.00 will be charged per month after 90 day of installation date.

9.2          All legal fees will be charged to the outstanding account if its not paid after 120 days of the installation day.
